Acceptable Use Policy
This Policy forms part of the Agreement between the Client and SpikeWug Pty Ltd and is binding on Clients using SpikeWug Pty Ltd services.
General
By contracting with SpikeWug Pty Ltd for services, the Client agrees to be bound by this Policy and related SpikeWug policies.
The purpose of this AUP is to:
- ensure compliance with the relevant laws of the Republic;
- specify what activities and online behaviour are considered unacceptable use of the service;
- protect the integrity of the SpikeWug Pty Ltd network; and
- specify the consequences that may flow from prohibited activities.
SpikeWug Pty Ltd respects Clients' rights to freedom of speech and expression, access to information, privacy, human dignity, religion, belief and opinion.
Unacceptable use
SpikeWug Pty Ltd services may only be used for lawful purposes. Prohibited uses include (among others):
- Any violation of laws prohibiting child pornography, obscenity, discrimination, hate speech, or speech designed to incite violence
- Activity designed to defame, abuse, stalk, harass or physically threaten any individual
- Violation of intellectual property laws
- Violation of another's right to privacy, including collecting personal data without consent
- Fraudulent activity, including pyramid schemes and impersonation
- Violation of exchange control laws of the Republic
- Sale, transmission or distribution of pirated or illegal software
Threats to network security
Unacceptable activities include attempts to gain unauthorised access, cracking/hacking, spoofing, denial-of-service attacks, distributing malware, unauthorised monitoring of traffic, running services with known vulnerabilities, and failing to respond adequately to DOS/DDOS attacks.
Definitions
Throttling limits the throughput of services and protocols.
Shaping implements protocol-based priority to manage demand, giving interactive services higher priority over non-interactive ones.
Pure Uncapped WiFi
All Pure WiFi packages are uncapped, unshaped and unthrottled. There are no usage thresholds. No throttling or shaping will ever be applied.
Home, Premium and Business Uncapped WiFi
Home Uncapped packages have a threshold (30-day rolling window) after which speeds may be subject to shaping and throttling based on network demand. Premium and Business packages follow the published product rules.
Home Uncapped packages are subject to throttling only when a user has reached their monthly threshold, and only during peak demand periods when required.
Monthly thresholds (FUP examples):
- 2 Mbps: 150GB — stays 2Mbps for the month
- 4 Mbps: 200GB — throttled to 2Mbps for remainder of month
- 6 Mbps: 250GB — throttled to 4Mbps for remainder of month
- 8 Mbps: 300GB — throttled to 4Mbps for remainder of month
- 10 Mbps: 350GB — throttled to 4Mbps for remainder of month
- 12–22 Mbps: 400GB — throttled to 4Mbps for r
